Collateral estoppel¶
The issue-preclusion doctrine barring relitigation of a fact or law issue already actually litigated, necessarily decided and covered by a final valid judgment under applicable party and fairness rules.
Core Idea¶
Collateral estoppel, now commonly issue preclusion, prevents a party from contesting an issue conclusively resolved in an earlier action even when the later claim differs.[1] A court compares issue identity and the prior record, then gives the necessary determination binding effect to protect finality, consistency and judicial resources subject to due-process limits. The abstraction is therefore identified by a declared carrier, a transformation or constraint over that carrier, and an invariant that tells an analyst whether the named structure is genuinely present.
The load-bearing residual is not the broad topic of civil procedure. It is issue-level preclusion across different claims rather than whole-claim merger or bar. That residual remains recognizable when examples, notation, scale, or implementation change, but it disappears if the carrier is mistyped, the condition that the same issue was actually litigated and necessarily determined by a valid final judgment and binding it in the later case satisfies the jurisdiction's party and fairness requirements fails, a neighboring object is substituted, or notation and topical resemblance replace the constitutive test.
