Commodity form theory¶
Pashukanis’s jurisprudential theory that capitalist legal form parallels commodity exchange by constituting formally equal legal subjects as guardians of alienable property.
Core Idea¶
The theory is historically specific and contested over public law, coercion, race, gender and nonmarket legal relations; it is an explanatory account of legal form, not a claim that every rule is a literal commodity. Generalized commodity exchange requires autonomous owners capable of contract, and law abstracts persons into formally equal subjects whose rights and obligations enable circulation despite material inequality. The abstraction is therefore identified by a declared carrier, a transformation or constraint over that carrier, and an invariant that tells an analyst whether the named structure is genuinely present.
