Data sovereignty¶
The governance principle that data is subject to the authority and legal regime of the jurisdiction with a recognized territorial or institutional claim over it.
Core Idea¶
Sovereignty differs from residency and localization, multiple jurisdictions can assert overlapping authority and technical storage location alone does not settle control, access or applicable law. Jurisdictional connecting factors such as creation, subjects, controller, storage or processing activate legal claims, and governance arrangements allocate custody, access, transfer and compliance under those claims. The abstraction is therefore identified by a declared carrier, a transformation or constraint over that carrier, and an invariant that tells an analyst whether the named structure is genuinely present.
Scope of Application¶
Data sovereignty belongs to data governance and is useful where the analyst can specify the typed data governance carrier, including objects, relations, parameters, conventions, evidence, boundaries, and comparison targets, then evaluate the data and lifecycle, relevant people organizations and state, jurisdictional connecting factors, asserted legal authority, controller processor and custodian roles, storage processing and transfer locations, access and disclosure powers, conflict-of-laws and treaty context and governance and audit controls are explicit.
Clarity¶
The abstraction clarifies a crowded vocabulary by making the data and lifecycle, relevant people organizations and state, jurisdictional connecting factors, asserted legal authority, controller processor and custodian roles, storage processing and transfer locations, access and disclosure powers, conflict-of-laws and treaty context and governance and audit controls are explicit the center of the account. Manages Complexity¶
