Golden rule (law)¶
A statutory-interpretation rule directing a court to depart from an ordinary grammatical reading when that reading would produce an absurd, inconsistent or repugnant result.
Core Idea¶
The golden rule is traditionally described as a narrow modification of the literal rule: wording retains its ordinary sense unless that sense creates an outcome the legal system cannot plausibly attribute to the legislature. The interpreter begins with the text's ordinary meaning, identifies a qualifying anomaly in context, selects the smallest available alternative construction that removes it and checks that the revision remains textually possible. The abstraction is therefore identified by a declared carrier, a transformation or constraint over that carrier, and an invariant that tells an analyst whether the named structure is genuinely present.
Scope of Application¶

Clarity¶

A claim should name the carrier, the governing operation or relation, the applicable assumptions, and the recognition test.
