Intangible property¶
A legally recognized ownership interest in a nonphysical right, claim, entitlement, or statutory creation that can be held and often transferred under governing law.
Core Idea¶
Intangible property includes intellectual-property rights, debts, shares, contractual claims, licenses, goodwill, and other incorporeal interests whose existence and transfer depend on legal institutions rather than physical possession.[1] A legal rule identifies the right-holder, object and incidents of ownership, records or evidence the entitlement, and governs transfer, exclusion, duration, priority, and remedies. The abstraction is therefore identified by a declared carrier, a transformation or constraint over that carrier, and an invariant that tells an analyst whether the named structure is genuinely present.
The load-bearing residual is not the broad topic of property law. It is the domain-specific identity determined by the jurisdiction, right or claim, holder, legal source, transferable incidents, duration, priority, and enforcement rules establish an owned nonphysical entitlement.
