Core Idea

An interlocutory injunction is a court's provisional, binding direction about conduct while a substantive dispute remains unresolved. The court acts before final entitlement is established because waiting could undermine effective adjudication or relief. The order governs the interim period; it does not itself decide the ultimate merits. Lord Hope explains this provisional protective purpose in Attorney General v Punch.[^ref-8ad276fd74c0]

Four roles make the order recognizable: an unresolved substantive dispute, an interim risk, the court's provisional assessment and discretion, and an operative direction that can be reviewed or varied under its terms and governing law. Grant tests differ by jurisdiction. The Canadian Supreme Court's serious-issue, irreparable-harm, and convenience analysis in Google v Equustek is local to that decision, not a universal definition.[^ref-3408c4f12186]

Scope of Application

The remedy applies literally to judicial interim relief connected to unresolved merits. In Canada, courts ordered non-party Google to de-index search results worldwide during Equustek's underlying dispute with Datalink, and the Supreme Court upheld the interlocutory order.[^ref-3408c4f12186] In Australia, while Sanofi's patent claim remained unresolved, a Federal Court order restrained Apotex from manufacturing and selling generic clopidogrel pending determination or further order.[^ref-d0af2149febf]

These examples differ in subject matter, bound actor, and reach. They share the provisional judicial direction tied to a pending dispute. Non-party and worldwide reach are features of the Canadian case, not presumed powers of every court. The Australian 2024 judgment reproduces the historical 2007 order and damages undertaking, but does not provide every reason from the original grant hearing.[ref-3408c4f12186][ref-d0af2149febf]

Clarity

The term separates interim regulation from final entitlement. Ask what claim remains undecided, what may happen before decision, whom the court actually bound, and what conduct it ordered. The later Sanofi litigation included reversal of a final injunction and patent revocation; the earlier interim restraint did not settle patent validity.[^ref-d0af2149febf]

It also separates the granted order from an application, private demand, or undertaking as to damages. An application can be denied; an undertaking may accompany relief. A granted interlocutory injunction requires the court's binding conduct direction.

Manages Complexity

Interim disputes may involve many parties, possible harms, territories, and remedies. The four-role map keeps distinct the underlying claim, the risk of waiting, the provisional assessment, and the exact order. It also prevents the applicant, respondent, and bound person from being assumed identical: Google's non-party position matters in the Canadian case.[^ref-3408c4f12186]

This map does not replace local law. The Apotex undertaking as to damages and the Canadian court's discussion of variation if Google faced conflict with foreign law show that safeguards and reach must be read from the particular case.[ref-d0af2149febf][ref-3408c4f12186]

Abstract Reasoning

First identify the unresolved merits and the risk to useful later relief. Next identify the court's interim assessment and read the operative order: who must act or refrain, where, and until when or subject to what further order? Then distinguish a granted injunction from an application, voluntary promise, or final judgment.

This sequence permits bounded inference. A non-party can be bound under the Canadian decision, but that does not establish the same reach in every legal system.[^ref-3408c4f12186] A patent claimant can obtain provisional protection without proving that its patent will survive final review.[^ref-d0af2149febf]

Knowledge Transfer

The role test transfers between different judicial disputes. In Equustek, the conduct concerned search indexing by a non-party; in the Sanofi matter, it concerned a proposed generic manufacturer's activities.[ref-3408c4f12186][ref-d0af2149febf] The pending-merits and interim-order structure stays recognizable, but each jurisdiction's test, burden, safeguards, and powers must be established separately.

Calling a temporary managerial instruction an “injunction” is analogy unless a court issues a binding provisional order tied to unresolved merits. A general idea of acting provisionally under uncertainty may travel farther than this specific legal remedy.

Example

Google v Equustek. During litigation against Datalink, Equustek sought relief over continued online access. Canadian courts directed non-party Google to de-index results worldwide, and the Supreme Court upheld the interlocutory order. The court discussed possible variation if compliance required violation of another jurisdiction's law.[^ref-3408c4f12186] The pending claims supply the unresolved dispute; continued access supplies interim risk; the judicial grant supplies provisional assessment; and de-indexing supplies the binding, potentially revisable direction.

Sanofi and Apotex. During unresolved patent litigation, the Australian Federal Court restrained Apotex's proposed generic clopidogrel manufacture and sale until determination or further order. Sanofi gave an undertaking as to damages.[^ref-d0af2149febf] The patent claim, proposed launch, judicial grant, and restraint fill the same four roles. Later patent revocation confirms that an interim order does not decide ultimate entitlement.

Not to Be Confused With

  • A final permanent injunction: it may restrain similar conduct, but follows a different merits posture.
  • An application for interim relief: requesting an order does not mean one was granted.
  • An undertaking as to damages: it can accompany an order but is not the order's conduct command.
  • A simple status-quo freeze: an interlocutory order may require active conduct, as the Canadian de-indexing order illustrates.[^ref-3408c4f12186]
  • Periculum in mora: a danger-in-delay condition in some civil-law systems, not the injunction itself or a universal local test.
