Occupatio¶
A Roman-law mode of original acquisition by taking possession of an ownerless thing with intent to own it.
Core Idea¶
Occupatio applies to res nullius and, under disputed or jurisdiction-specific rules, certain abandoned movables, requiring factual control plus acquisitive intention rather than transfer from a prior owner. First possession converts an unowned object into private ownership when the legal order recognizes the object as appropriable and the taking as sufficient control. The abstraction is therefore identified by a declared carrier, a transformation or constraint over that carrier, and an invariant that tells an analyst whether the named structure is genuinely present.
