Substitution (law)¶
A jurisdiction-specific procedural right to replace an assigned judicial officer, either upon demonstrated cause or through a limited peremptory request.
Core Idea¶
Availability, timing, affidavit requirements, party eligibility and number of substitutions differ sharply by jurisdiction, and the right does not let a litigant choose the replacement judge. A party invokes the governing statute or rule before its deadline, the court tests cause or peremptory eligibility and reassignment selects another qualified judicial officer under ordinary allocation procedures. The abstraction is therefore identified by a declared carrier, a transformation or constraint over that carrier, and an invariant that tells an analyst whether the named structure is genuinely present.
