Diagnostic review — instantiates Deadweight Loss Reduction

The intake diagnostic: locates the wedge blocking beneficial activity, separates the genuinely wasteful part from the part that protects something, and sizes the recoverable loss.

Before anyone reaches for a redesign, someone has to establish that there is a repairable wedge at all — and that repairing it will not quietly demolish a protection. Distortion-Reduction Review is that intake diagnostic. It does three things and stops: it maps the rule, price, friction, or allocation constraint that stands between what people could beneficially do and what they actually do; it splits that barrier into an avoidable distortion and a protected purpose (safety, rights, fairness, externality control, legitimacy); and it sizes, roughly, the value the avoidable part is destroying. Its whole reason to exist is the separation step — the discipline that keeps the archetype from collapsing into "fewer rules, lower costs." The review does not decide, does not weigh, and does not change anything; it hands a clean problem statement — here is the wedge, here is the part that must be preserved, here is roughly how much surplus is stranded — to the mechanisms that do.

Example

A city requires every new apartment to include at least 1.5 off-street parking spaces. The Distortion-Reduction Review starts by naming the wedge: the mandate adds structured-parking cost to every unit, which quietly kills small infill projects on tight lots and pushes rents up on the ones that get built. Then comes the move that matters — separating the two things the rule is doing. The protected purpose is real: without any parking, some buildings would push cars onto already-crowded residential streets. The avoidable distortion is that the rule mandates far more parking than tenants in transit-rich blocks actually want, on lots where a garage is the difference between a project that pencils out and one that never breaks ground.

The review sizes the stranded value not to the dollar but to the decision: in the transit-served zones, a meaningful share of stalled small projects would proceed if the minimum dropped, and the spillover the rule guards against could be held by a much lighter tool. That is the output — a wedge, a preserved purpose, and a magnitude — and it is deliberately not a recommendation. It tells the next mechanisms what to repair and what not to touch, and it flags that the protected purpose here can be met by a residential permit-parking safeguard rather than a blanket mandate.

How it works

  • Map the wedge, not just the rule. Trace the specific barrier — the fee, permit, quota, price, or matching failure — and the behavior it changes: the trade not made, the capacity left idle, the low-value substitution. A rule is only a distortion if you can name the beneficial activity it blocks.
  • Split avoidable from protected. For each barrier, ask what would be lost if it vanished entirely. The part whose loss is acceptable is the avoidable distortion; the part whose loss is not is the protected purpose that any repair must preserve or replace. Most real barriers are a mixture, and naming the mixture is the point.
  • Size the recoverable loss, roughly. Approximate the blocked surplus well enough to compare — magnitude and direction, whose value is being counted, and the assumptions in dispute — without pretending to precision the situation doesn't support.

Tuning parameters

  • Separation strictness — how demanding the test is before a barrier's purpose counts as genuinely "protective." Set it loose and you rationalize waste as safety; set it tight and you strip real protections. This is the review's highest-stakes dial.
  • Wedge scope — whether you map one barrier or the whole tangle of overlapping rules acting on the same activity. Wider scope catches compounding frictions; narrower keeps the diagnosis actionable.
  • Sizing effort — a back-of-envelope magnitude versus a modelled estimate of stranded surplus. Match it to how consequential and contested the repair will be.
  • Purpose attribution — how charitably you infer why a barrier exists when no one remembers. Assume a live protective reason and you freeze waste; assume none and you may delete a safeguard whose rationale was simply never written down.

When it helps, and when it misleads

Its strength is that it refuses the two framings that wreck this work: "all barriers are waste" and "all barriers are there for a reason." By forcing every barrier into an avoidable part and a protected part, it turns a political argument into a diagnosis the later mechanisms can act on, and it makes the stranded surplus — the classic deadweight loss, the value destroyed with no offsetting gain — explicit enough to weigh.[1]

Its failure mode is that the separation is only as honest as the person drawing the line. The review is the easiest place in the whole archetype to launder a predetermined conclusion: an incumbent who wants the rule kept calls the whole thing protective; a deregulator who wants it gone calls the whole thing waste. Run backwards, it manufactures the answer someone already wanted. The discipline that guards against this is to state the protected purpose and the avoidable distortion as two separate, individually defensible claims — each of which a sceptic on the other side would accept — before any redesign is discussed, and to hand the surplus-sizing to a formal weighing rather than settling it inside the diagnosis.

How it implements the components

Distortion-Reduction Review realizes the archetype's diagnostic core — the components that define the problem before anything is changed:

  • distortion_map — its first output: the specific wedge between potential value and actual behavior, with the visible barrier separated from the underlying reason it exists.
  • protected_constraint_safeguard — the separation step names the non-negotiable protection any repair must preserve or replace, keeping the review from becoming an argument for blanket deregulation.
  • surplus_estimate — a rough, honestly-bounded sizing of the value the avoidable portion is destroying, stated well enough to compare.

It does NOT run the formal welfare weighing (cost_benefit_assessment_frame, sensitivity_analysis, distributional_review) — that belongs to Cost–Benefit Assessment Protocol; it does not display the party-by-party incidence (affected_party_incidence_map) — that is Impact Assessment Table; and it proposes no change (redesign_lever), which the redesign mechanisms supply.

Notes

The review deliberately stops before judgment. It is tempting to fold the "is it worth repairing?" question into the same pass, but keeping the diagnosis separate from the verdict is what lets a team improve one without re-opening the other — a better surplus estimate does not force a re-argument about which redesign to use, and a rejected redesign does not invalidate the map of the wedge.

[1] Deadweight loss is the standard economic term for surplus destroyed by a distortion — value that would have been created by a trade or use that the wedge prevents, accruing to no one. It is the quantity this whole archetype exists to recover, which is why sizing it is part of the intake diagnosis rather than an afterthought.
