Policy Intensity Band¶
Method — instantiates Therapeutic Window Management
Sets policy strength within an effective and legitimate range.
Policy Intensity Band is a method for choosing how hard a policy lever pushes — the size of a fine, the frequency of enforcement, the tone of a campaign — so it is strong enough to change behavior but stops short of the point where it forfeits public legitimacy. Its defining constraint is social, not physical: the ceiling is set by backlash, reactance, and loss of trust, so that a lever pushed too hard does not merely hit diminishing returns but actively backfires, breeding defiance and eroding the standing the policy needs to work at all. The method keeps a running ledger of behavioral effect against legitimacy cost and picks the intensity where net benefit is highest, watching both columns as the public responds.
Example¶
A city wants to cut speeding on a corridor with a rising crash toll. The lever is enforcement intensity: fine size and how many automated speed cameras run. Too little — a token $25 fine, one camera — and drivers ignore it; speeds and crashes barely move. Too much — a $500 fine with cameras every few blocks — and something worse than diminishing returns happens: residents read it as a revenue trap, a backlash campaign forms, drivers cover plates and lobby to rip the cameras out, and the enforcement loses the legitimacy that made compliance voluntary. The band method sets intensity in between: a moderate fine with cameras concentrated at the highest-crash intersections, paired with visible signage explaining why. The team keeps a scorecard — measured speed reduction and crash trend in one column, complaint volume, appeal rates, and survey-measured perceived fairness in the other — and reads both after each change, ready to ease off if the legitimacy column deteriorates faster than safety improves.
How it works¶
The method's core is the paired ledger. Rather than optimizing a single effectiveness number, it scores each candidate intensity on both behavioral change and legitimacy cost, and it treats the legitimacy side as a hard ceiling: past a certain push, further intensity is charged as net-negative because backlash undoes compliance. Response is monitored on both columns continuously — because the public's reaction to a policy is not fixed, the same intensity that was accepted last year can cross the legitimacy ceiling this year. The output is a chosen strength plus the evidence that it sits below the backfire point.
Tuning parameters¶
- Effectiveness-versus-legitimacy weighting — how much a unit of behavior change is worth against a unit of lost trust. Weighting effect heavily pushes intensity up toward the backlash edge.
- Legitimacy ceiling placement — how much backlash headroom to leave. A conservative ceiling protects standing but may leave the policy too weak to bite.
- Enforcement salience — how visible and explained the lever is. Transparent enforcement buys legitimacy at a given intensity; covert enforcement spends it.
- Rollout gradient — introducing full strength at once versus phasing in. Phasing lets the legitimacy column be read before the lever is fully committed.
- Segmentation — one uniform intensity versus targeting the highest-harm cases, which concentrates effect while limiting the population that feels pushed.
When it helps, and when it misleads¶
Its strength is that it refuses the false "tougher is always better" framing and makes the social ceiling explicit, so a policy is set where it actually changes behavior without provoking the resistance that unravels it. It takes seriously that pushing people too hard can trigger reactance[1] — a motivated rebound against a perceived threat to freedom — which is precisely why the upper bound is legitimacy, not physics.
Its failure mode is measuring only the effectiveness column: enforcement statistics look great right up until the backlash arrives, because the legitimacy cost is a lagging, harder-to-quantify signal that a compliance dashboard omits. The classic misuse is escalating intensity in response to early non-compliance — reading weak results as "not hard enough" and pushing straight through the legitimacy ceiling. The guarding discipline is to keep the scorecard genuinely two-sided, instrument the legitimacy column with real measures (appeals, complaints, perceived-fairness surveys), and treat a deteriorating trust trend as a reason to ease off, not to double down.
