Example

The 2017 election for the 94th district of the Virginia House of Delegates ended, after a recount, in an exact tie between the two candidates.[1] Every legitimate criterion — the votes themselves — had been counted and recounted and still could not separate them. Rather than manufacture a distinction (disqualify a marginal ballot on a stretch, or invent a secondary rule after the fact), the outcome was settled by drawing a name from a bowl: each candidate's name sealed in a film canister, one canister drawn, that candidate seated. The chance draw did not override the voters; it operated only on the residue the voters had left exactly even, and everyone affected understood that a recorded draw — not a hidden judgment — had decided it.

How it works

  • Confirm the tie is genuine. The legitimate criteria must be fully applied and the remaining difference must be non-substantive; if a criterion could still separate the options, the tie is not real yet and chance is out of bounds.
  • Name chance's job precisely. Its purpose is an honest residual choice — to avoid fabricating precision — not to allocate, order, or evaluate anything.
  • Run and record a witnessed draw, and tell the affected parties plainly that a recorded draw resolved a true tie, because that transparency is what keeps the outcome legitimate rather than suspicious.
