A Sunset Clause Register is a register that, at the moment a temporary tooth is admitted, stamps it with a pre-committed expiry date and a reauthorization test, and then tracks that population of dated, expiring teeth to their termination. Its defining move is time-triggered default death: a tooth in the register will expire on its date unless someone affirmatively renews it — the burden of action falls on continuation, not on removal. It is the calendar-based counterpart to a relevance review: where a review periodically asks "does this still make sense?", the register simply declares "this ends on this date unless renewed," and its scope is specifically the temporary, exceptional teeth that most easily ossify into permanence.
Example¶
A legislature passes a package of emergency measures during a crisis — expanded executive spending authority, temporary surveillance powers, relaxed procurement rules. History says such "temporary" measures ossify into permanent law. So the legislature attaches sunset clauses and maintains a Sunset Clause Register: each measure is entered with an expiry date (say, 24 months out) and a reauthorization requirement (an affirmative floor vote with a continued-need justification). On the date, the measure lapses automatically unless the legislature actively renews it — the same discipline that surveillance statutes have used to force periodic re-debate rather than silent permanence. The register's whole force is the default: a measure no one bothers to defend simply dies on schedule, flipping the ratchet's asymmetry so that inaction now removes rather than preserves. Renewal is not a rubber stamp; it demands a fresh justification, so a kept measure is re-chosen rather than merely defaulted into the next decade.
How it works¶
- Stamp expiry at admission. The expiry date and reauthorization test are set when the temporary tooth enters, not negotiated later under status-quo pressure.
- Default to expiry. Absent affirmative renewal, the tooth lapses automatically on its date; continuation requires action, removal requires none.
- Track the temporary population. The register holds specifically the dated, exceptional teeth — those most prone to quiet permanence — with their dates and renewal status.
- Force re-debate at renewal. Renewal demands a fresh justification, so a kept tooth is re-chosen, not defaulted.
Tuning parameters¶
- Default horizon — how long until expiry; short horizons force frequent re-justification but churn, long ones drift back toward permanence.
- Renewal strictness — how hard renewal is (a simple extension versus a full re-justification and vote); stricter kills more dead teeth but burdens the live ones.
- Grace behavior — whether a missed renewal means a hard lapse or a grace window; hard lapse is disciplined but risky if a live tooth is forgotten.
- Scope — which teeth get sunsets (only emergency/temporary, or all additions); broader is stronger but heavier.
When it helps, and when it misleads¶
Its strength is that it is the cleanest fix for the "temporary measures with no expiration become permanent" symptom, because it makes removal the default and puts the effort-burden on retention — the exact inversion a ratchet needs.[n1]
Its failure mode is pro-forma reauthorization, where renewal becomes an automatic omnibus vote and the sunset is theater, or expiries set so far out they never bind. It can also create dangerous cliffs — a genuinely-needed tooth lapsing because a renewal slipped through a busy calendar. The classic misuse is sunsetting the trivial while the load-bearing exceptions get quietly folded into permanent law without the fresh justification the clause demanded. The discipline that guards against this is to require substantive re-justification (not omnibus renewal) at each sunset, set horizons short enough to bind, and monitor for teeth migrating off the register into permanence.
