A Sunset Review with Reauthorization flips the default of a policy, program, rule, or tool from automatic continuation to automatic expiry. Its defining move is the reversal of the burden of proof: rather than requiring someone to argue for stopping, it makes the thing lapse at a set date, cycle, or condition unless someone actively re-justifies it. Continuation must be re-earned; silence ends it. Example¶
A state agency issues a technical regulation and, following good practice, attaches a five-year sunset clause. Under an ordinary rule, the regulation would persist indefinitely on bureaucratic inertia; under the sunset provision, it expires on its fifth anniversary unless the agency affirmatively renews it. As the date approaches, the scheduled review forces the marginal question: is the next five years of this rule still justified, given how the industry and its risks have changed?
The review finds most of the regulation obsolete — the technology it governed has moved on — so those provisions are allowed to lapse rather than being defended into permanence. But a core safety requirement is still doing real work, and letting the whole rule expire would drop that baseline protection by inattention. The protected-obligation check catches it: the safety floor is carved out and reauthorized on a renewed, documented justification, while the obsolete scaffolding sunsets. Continuation was not automatic and expiry was not blind — each piece had to earn its next term, and the record shows why.
How it works¶
- Attach an expiry. Bind the policy or program to a sunset date, cycle count, or triggering condition, so it ends by default.
- Schedule the review before the date. A calendared review precedes expiry, forcing the "is the next term justified?" question while there is still time to renew.
- Demand renewed justification. Reauthorization requires a fresh, substantive case for continuation — recorded, not rubber-stamped — so the default of expiry is overridden only on evidence.
- Check the protected floor. Before anything lapses, confirm that expiry won't silently drop a baseline obligation; carve out and preserve what must continue regardless.
- Authorize explicitly. Renewal is a named act by an accountable authority, on the record, with the next sunset set.
Tuning parameters¶
- Sunset interval — how long each term runs. Short intervals force frequent scrutiny but pile on review burden and instability; long ones reduce churn but let weak programs run for years.
- Trigger type — whether expiry is date-based, cycle-based, or condition-based. Date triggers are predictable; condition triggers fire when circumstances actually change but are harder to administer.
- Reauthorization bar — how substantive the renewal case must be. A high bar kills zombies effectively but risks lapsing a good program on a busy cycle; a low bar invites rubber-stamping.
- Protected-floor scope — how much baseline is fenced off from expiry, balancing the discipline of the sunset against the risk of dropping a genuine obligation.
When it helps, and when it misleads¶
Its strength is defeating persistence-by-default, the way programs and rules accumulate simply because ending them requires effort no one is assigned to make. The classic instrument is the sunset provision — a clause that terminates a law or agency on a set date unless the legislature renews it — which converts continuation from the path of least resistance into an act that must be chosen.[n1]
The characteristic failure is the ceremonial reauthorization, where renewal becomes a rubber stamp and the sunset provides only the appearance of scrutiny — and its opposite, a valuable program lapsing through inattention on a crowded review cycle. A sharper danger is using a sunset to quietly let a protected obligation expire — the very move the floor exists to prevent.
