How it works¶
Its signature is that every guideline travels with its rationale, which is what makes purposive extension possible. The manual deliberately under-specifies — it is a standard, not a rule — but anchors that openness with an explicit purpose and worked reasoning, so the latitude is bounded by intent rather than left blank. Tuning parameters¶
- Reason depth — how much rationale accompanies each guideline. Deeper reasons enable faithful extension to new cases but bloat the manual and give more surface to lawyer around.
- Criteria openness — how open-ended each criterion is left. More open adapts to context; it also widens the variance between two deciders reading the same words.
- Purpose primacy — how strongly the stated purpose governs when criteria pull in different directions. A strong purpose anchor keeps hard cases coherent but concentrates interpretive power in the purpose's exact wording.
- Worked-example density — how many illustrative cases are shown. More examples teach faster but risk being misread as an exhaustive list, quietly re-rigidifying the standard.
- Revision cadence — how often the manual absorbs new situations. Stale guidance silently diverges from actual practice and loses its authority.
When it helps, and when it misleads¶
Its strength is that it governs the vast middle of cases without convening a body or filing a form — by teaching intent, so judgment scales across many deciders while staying teachable and reviewable. It is the mechanism that makes purposive interpretation[n1] operable: state the purpose, and deciders can extend it to the unforeseen without inventing it.
It misleads in two opposite directions. A purpose-and-reasons document can be quoted selectively to dress up a predetermined answer — the manual run backwards, to justify rather than to guide — and an out-of-date manual legitimizes drift by blessing yesterday's reading as doctrine. The opposite failure is readers treating the reasoned guidance as a rigid checklist, recreating exactly the brittleness it was meant to soften.
