Old-Position Sunset Clause¶
Governance instrument — instantiates Defensible Boundary Retreat
Puts a fixed expiry on the commitment to hold a position so it must be actively renewed to continue, flipping the default from indefinite holding to scheduled retreat unless the case to stay is remade on the record.
Most retreat decisions die of inertia: holding is the default, so doing nothing means holding forever, and someone has to summon the will to say "stop." Old-Position Sunset Clause removes the need for that will by flipping the default. Its defining move is to fix, in advance and in writing, a date on which the commitment to hold the position automatically expires unless it is affirmatively renewed — so continuing to hold now requires a positive act of re-justification, while retreat requires only the passage of time. It converts an open-ended commitment into a term-limited one, moving the burden of proof onto those who want to stay rather than those who want to leave. It is a pre-committed, time-based instrument, not a live judgment: it says by when, and leaves whether the evidence yet warrants leaving to the analysis and monitoring around it.
Example¶
A national government has propped up a large but uncompetitive steelworks for years to preserve regional jobs. Each budget cycle the subsidy is quietly rolled over, because ending it would mean an official deciding to "let the plant die" — politically radioactive. The result is an indefinite hold with a rising cost and no forcing function. A sunset clause rewrites the deal. The support is re-legislated with a hard five-year expiry and a step-down schedule: unless the legislature actively re-authorizes it before the date, funding tapers and ends, and the accompanying transition plan — retraining, site remediation, investment incentives — executes by default.
Renewal is not forbidden, but it now requires a positive vote, a published case that the plant has a credible path to viability, and a supermajority. The default has flipped from "support continues unless someone dares to stop it" to "support ends unless someone makes the case to continue." The plant may still win renewal if it genuinely deserves it; what it can no longer do is coast indefinitely on the inertia of nobody wanting to be the one to pull the plug.
How it works¶
- Fix the expiry before the horizon, not by calendar convenience. The sunset date is set to fall while orderly retreat is still possible, so expiry cannot arrive after the window to move well has already closed.
- Make the default the retreat. On the date, absent action, the wind-down or step-down executes — inaction produces withdrawal, not continuation.
- Put the burden of proof on staying. Renewal requires an affirmative, on-the-record case (and often a raised bar — supermajority, published justification), so continuing to hold is a decision someone must own.
- Cap the renewals. A limit on how many times the position can be re-authorized keeps the sunset from decaying into a rubber-stamp formality.
Tuning parameters¶
- Term length — how long each authorization runs. Short terms force frequent re-justification but add governance churn; long terms are stable but let a position drift far before the next check.
- Renewal bar — simple majority, supermajority, or independent sign-off. A higher bar makes continued holding harder to wave through but risks expiring a position a plain majority still wants.
- Default action on expiry — full retreat, or a graduated step-down. Full expiry is a stronger forcing function; a step-down is gentler but softer, and can blur into indefinite tapering.
- Renewal cap — how many re-authorizations are allowed before retreat becomes mandatory. A hard cap defeats perpetual renewal but removes discretion if the position genuinely still merits holding.
- Notice period — how far ahead of expiry the wind-down machinery must be readied. Long notice makes the default executable; short notice risks a paper sunset that cannot actually fire.
When it helps, and when it misleads¶
Its strength is that it defeats sunk-cost escalation structurally rather than heroically — no one has to be brave, because the brave act (stopping) is what happens automatically. It is the logic of the legislative sunset provision, under which a law, agency, or program terminates on a set date unless renewed, forcing periodic re-justification of things that would otherwise persist by inertia.[n1]
It misleads because a sunset is only as strong as its renewal review. The classic failure is the ceremonial renewal — reauthorization rubber-stamped every cycle without real scrutiny, so the clause becomes theater that launders indefinite holding as periodic choice. The mirror risk is a date set too rigidly, expiring a position that genuine new evidence shows is still worth holding. The guarding discipline is to make the renewal review substantive and evidence-fed — ideally consuming a fresh hold-vs-retreat analysis — and to align the sunset date with the reversibility horizon rather than with a convenient budget cycle.
How it implements the components¶
Old-Position Sunset Clause realizes the time-based decommitment machinery of the archetype — the automatic complement to evidence-based timing:
