A Peer Case Conference is a recurring meeting where decision-makers bring live or recent discretionary cases to their peers for collective deliberation. A national refugee agency's caseworkers face cases where the rule — a "well-founded fear" of persecution — cannot resolve credibility from the file alone. Each week they convene a case conference. Officers bring two or three borderline cases; peers question the reasoning, compare each aloud to how similar claims were decided, and settle on a shared reading. A newer officer absorbs the house norm for weighing inconsistent testimony without being lectured on it; the group notices that two officers have been diverging on the same fact pattern and closes the gap before it hardens into a systematic split between them. The alignment happens in the room, in real time, on the actual cases.
How it works¶
Its distinguishing features are all about live deliberation. It works on specific, current cases rather than aggregate statistics; precedent is built and transmitted socially, through discussion, before it is ever written down; and judgment is calibrated peer-to-peer through challenge, on a recurring cadence. What separates it from a library or an audit is that consistency here is produced by people reasoning together — not by retrieving a stored precedent or reading a drift metric off a chart.
Tuning parameters¶
- Cadence and caseload — how often it meets and how many cases per session. More cases per meeting trade depth of discussion for breadth of coverage.
- Case selection — self-nominated hard cases, a random sample, or flagged outliers. Each surfaces different divergence, and self-nomination misses the calls people don't know they're getting wrong.
- Facilitation style — Socratic challenge versus consensus-seeking. Challenge resists premature agreement but can intimidate junior members into silence.
- Record-keeping — whether the room's conclusions are written down as precedent or left tacit. Capture makes the norms reviewable but slows and formalizes the discussion.
- Psychological safety — how safe it is to bring a bad call. Higher safety surfaces the genuinely hard cases; lower safety turns the conference into performance for the room.
When it helps, and when it misleads¶
Its strength is that it aligns judgment exactly where it is tacit and resists codification, trains newer deciders as a by-product, and catches divergence early and humanely — before it becomes an entrenched pattern.
Its failure mode is the shadow of its strength: a recurring consensus room is precisely where groupthink[n1] forms. The group converges on a comfortable norm and suppresses the dissent that would have caught error, and a dominant voice can set precedent that is never written down or reviewed. Left to itself it drifts as a body, with no external mirror. The discipline that guards against this is to rotate facilitation, protect and record dissent, sample cases rather than only accepting self-nominated ones, and feed the room's conclusions to a calibration or audit mechanism so its norms stay reviewable from outside.
