Bounds a reading by laying the current case beside authoritative prior readings and mapping, feature by feature, which precedent it actually resembles.

The Precedent Comparison Table interprets a case by placing it in a row beside the prior cases whose readings already carry authority, and mapping — feature by feature — which precedent the present substrate genuinely resembles and which it only superficially echoes. Its distinctive move is anchoring meaning to established readings rather than deriving it fresh: instead of asking "what could this mean?", it asks "which already-authoritative reading does this case fall under, and where does it break from the nearest one?" The columns are the discriminating features; the rows are the precedents plus the case at hand; and the output is a bounded reading — this case is governed by precedent A, distinguished from B on feature X — that inherits the warrant of the precedents it matches.

Example

A bank's compliance team must decide whether a new "buy-now-pay-later at point of sale" product falls under an internal rule written for "consumer credit." The clause is ambiguous, and reading it fresh invites motivated interpretation. Instead they build the table. Rows: four prior internal determinations (a store card, a payroll advance, a merchant invoice-financing deal, a layaway plan) plus the new product. Columns: the features that actually drove those rulings — who bears default risk, whether interest accrues, whether a third-party lender is involved, and the repayment horizon.

Filling the grid, the new product lines up almost exactly with the store-card precedent (classified as consumer credit) and is distinguished from invoice-financing (which was not) on the risk-bearer and lender columns. The reading that results — "governed by the store-card determination; the merchant-financing exclusion does not reach it, because the consumer bears the obligation" — is defensible precisely because it hangs on named prior readings and the specific features that discriminate them: the same reasoning-by-analogy that underlies precedent itself.[1]

How it works

  • Assemble the precedents. Gather the prior cases whose readings already carry authority in this domain — rulings, determinations, canonical interpretations.
  • Name the discriminating features. Make columns of the features that actually drove those prior readings, not every describable attribute.
  • Map the current case in. Fill the row for the substrate at hand and read off its nearest precedent and its points of departure.
  • Bound the reading. Conclude with the precedent the case falls under and the features distinguishing it from the next-nearest — inheriting warrant where it matches, flagging novelty where it doesn't.

Tuning parameters

  • Precedent-set breadth — how many and how far-afield the prior cases are. A wider set finds a closer analog but risks importing precedents from a different authority regime.
  • Feature selection — which attributes become columns. The whole reading turns on this; columns chosen to reach a desired row are the table's characteristic abuse.
  • Authority weighting — how much more a binding precedent counts than a merely persuasive one. Heavy weighting stabilizes readings; too heavy freezes a bad precedent in place.
  • Similarity threshold — how close a match must be before the case is treated as governed rather than novel. Loose thresholds over-assimilate; tight ones declare everything unprecedented.
  • Distinguishing latitude — how readily a case may be marked "distinguished" from a precedent it otherwise resembles. Generous latitude preserves nuance but is the lever motivated readers pull to escape unwanted precedent.

When it helps, and when it misleads

Its strength is that it makes a reading inherit accountability instead of asserting it — the interpretation is only as strong as the precedents it matches and the features that discriminate them, both of which sit on the table for anyone to contest. It stabilizes interpretation across cases and interpreters, exposes when a "new" situation is really an old one, and turns an argument about meaning into a checkable argument about similarity.

Its failure modes are precedent's own. Feature columns can be gerrymandered to route a case to a favored precedent; a genuinely novel case can be forced under a superficial analog (false analogy); and a wrong or outdated precedent, once anchored, propagates its error to every case compared against it. The table is also easily run backwards — the desired classification chosen first, then the columns and precedents assembled to reach it. The discipline that guards against this is to fix the discriminating features before locating the case among them, to justify each "distinguished" call on a feature that genuinely drove the prior reading, and to revisit anchor precedents themselves rather than treating them as permanently settled.

How it implements the components

The Precedent Comparison Table realizes the analogy-to-authority side of the archetype — reading by likeness to prior warranted readings:

  • authority_or_precedent_anchor — its core: binds the reading to prior cases whose interpretations already carry authority.
  • admissible_reading_boundary — the matched precedent and its distinguishing features bound which reading is admissible for the case at hand.
  • evidence_mark_trace — each cell ties the case and its precedents to the specific features (marks) that drove their readings, so the analogy is inspectable rather than asserted.
