Proportionality Balancing Record¶
Reasoned evaluation — instantiates Rights–Freedoms Obligation Mapping
Records the reasoned weighing of a constraint's burden against its justified purpose, preserving the evidence, the value judgments, and the dissent behind the call.
The Proportionality Balancing Record is where a constraint is weighed, not merely gated. Its defining move is a graded, recorded judgment: it establishes that the purpose is legitimate, that the evidence and harm definition support it, and that the actor has authority — and then it weighs the magnitude of the burden imposed against the importance of the purpose served, writing down the reasoning, the evidence relied on, the value premises that tipped it, and the dissent of anyone who weighed it differently. It produces a durable, contestable account of why this burden was judged worth this purpose. It does not search for narrower alternatives and it does not deliver a pass/fail — it grades, and it preserves the grading so a later reviewer can see the argument rather than just the verdict.
Example¶
A city considers installing continuous CCTV coverage across a residential neighborhood after a rise in break-ins. The alternatives question — could a narrower measure work — has already been asked elsewhere; the record's job is the weighing. It first runs the justification test: is crime reduction a legitimate aim (yes), is there evidence the cameras would meaningfully reduce it (mixed, and the record says so), is the harm definition honest (deterrence gains are modest and uncertain), does the council have authority (yes, within limits). Then it weighs: the burden is continuous surveillance of residents going about ordinary life — a heavy, ongoing intrusion on a low-crime street — against a purpose whose expected benefit the evidence rates as modest. The record does not hide that this is a value call; it writes down how much weight each side got and why the burden was judged to outweigh the benefit here. Crucially, it captures the two council members who disagreed and their reasoning, rather than flattening a 5–2 vote into "the council decided." The output is a page a resident, a court, or a future council can read to see exactly what was traded, on what evidence, over what objection.
How it works¶
- Establish the justification first. Legitimate purpose, supporting evidence, an honest harm definition, and actual authority — a constraint that fails these is not weighed, it is rejected at the threshold.
- Grade both sides. Assign explicit weight to the severity and reversibility of the burden and to the importance and likelihood of the purpose's benefit; a graded weighing, not a checkbox.
- Name the value premises. Make explicit which judgments about what matters more did the actual tipping, so the call is contestable rather than presented as arithmetic.
- Preserve the dissent. Record minority reasoning and unresolved uncertainty alongside the adopted balance, so a single operating decision does not erase the disagreement behind it.
Tuning parameters¶
- Scrutiny intensity — how demanding the justification and weighing are, scaled to irreversibility, coercion, surveillance, and power asymmetry. Higher intensity protects against over-reach but slows serious decisions.
- Weighting explicitness — qualitative narrative versus semi-quantified weights on each side. Explicit weights invite challenge and consistency but risk false precision over incommensurable values.
- Dissent visibility — how prominently minority views and residual uncertainty are carried forward. High visibility preserves contestability; suppressing it manufactures false consensus.
- Evidence bar — how strong the evidence for the purpose's benefit must be before it earns weight. A high bar guards against speculative justification but can stall action under genuine uncertainty.
When it helps, and when it misleads¶
Its strength is legitimacy through transparency: it turns "we decided it was proportionate" into a readable argument whose evidence, weights, value premises, and dissent are all on the page and open to challenge. This is proportionality in the strict sense — the final balancing stage that asks whether the burden imposed is worth the benefit gained, after legitimacy and necessity are settled.[n1] Its failure mode is balancing theater: a record that recites the steps but quietly pre-loads the weights to reach a chosen result, using the ritual of "weighing" to launder a decision already made. The related misuse is collapsing dissent — writing the record as if the weighing were arithmetic and the minority simply wrong. The guarding discipline is to require the losing side's strongest version to appear in the record in its own terms, and to fix the evidence bar before the weights are assigned, so the balance is argued rather than staged.
