Proportionality Calibration

Scale response, restriction, remedy, or sanction to the severity, necessity, risk context, and affected interests of the case.

The Diagnostic Story

Symptom: Responses are too strong for small infractions and too weak for serious ones, mechanical sanction tables treat unlike cases alike, and collateral harm from an intervention can itself be larger than the harm it addresses. When decision makers face pressure — to look decisive after a salient incident, or to go easy on a connected party — the response drifts further from the severity of the actual case.

Pivot: Create a reviewable response-fit system that assesses severity and necessity, maps affected interests and burdens, selects the least-burdensome effective response, and defines escalation thresholds. Context can justify deviation, but deviation must be visible and constrained, not hidden.

Resolution: Responses become consistently matched to the harm, risk, and context of the case. Overreach decreases, under-response decreases, and the people subject to decisions can tell why the response was what it was. De-escalation remains possible, and the system can learn from past calibration errors.
