Invention (Rhetorical Canon)

Systematically canvass the arguments available in a case by visiting a fixed catalogue of topoi in turn, treating coverage of that space — not the quality of any one argument — as the standard of adequacy, before any choice of what to advance begins.

Core Idea

Invention (heuresis in Greek, inventio in Latin) is the first and foundational canon of classical rhetoric: the systematic search for the arguments, evidence, appeals, and lines of thought available in a given case before any choices about arrangement, style, or delivery are made. The canon's structural commitment is that persuasive material is not created from nothing but located within a known topology of available moves — the topoi (commonplaces) that serve as a catalogue of argument-types the rhetor visits in turn, asking at each whether it generates something defensible for this case: definition (how should the key terms be delimited?), division (what are the distinguishable parts or issues?), comparison (how does this case stand relative to similar cases?), cause and consequence (what produced the situation, and what follows from each possible response?), testimony (what authorities, witnesses, or precedents bear on this?). Invention is therefore a canvas-before-commit phase: the rhetor's first responsibility is not to select the best argument but to discover what arguments are available, because premature selection risks bypassing stronger material and committing to a position that later scrutiny will undermine. The canon was elaborated across the classical tradition — in Aristotle's Rhetoric, Cicero's De Inventione and Topica, and Quintilian's Institutio Oratoria — and distinguishes rhetoric's approach to argument-finding from both logical proof (which derives conclusions from given premises) and creative improvisation (which generates without systematic structure): invention is methodical discovery within a defined topological space, with coverage over that space as the criterion of adequacy.

What It Is Not

  • Not "invention" in the modern sense of creating something new. The English word now means originating a device or idea from nothing; the canon means the reverse — locating the arguments already available in the case, the audience, and the situation. The rhetor discovers persuasive material within a known topology, rather than fabricating it, so the ordinary connotation runs almost opposite to the classical sense.
  • Not creative improvisation. Free, unstructured generation lacks the canon's defining discipline: a coverage standard over a fixed catalogue of argument-types. Invention is methodical discovery within a defined topology; an inventive flourish that visits no places systematically — however clever — is not invention in the canonical sense, because it forfeits the assurance that no class of move was overlooked.
  • Not logical proof. Deriving conclusions from premises already granted is a different activity: proof operates on material taken as given, whereas invention finds the material in the first place. The canon precedes and supplies what proof and arrangement later work with; it does not itself adjudicate validity.
  • Not the task of selecting the best argument. Invention's job is to canvass what could be said, deliberately quarantined from the later, separate work of choosing what to advance. Collapsing the two is the very failure the canon guards against — hitting one plausible line and committing to it ends the search prematurely, before fuller coverage can improve or overturn the position.
  • Not satisfied by finding one strong argument. The criterion of adequacy is coverage of the argument space, an independently failable standard from the quality of any single line. A search that turns up a single excellent argument but skipped whole classes of available move is, by the canon's measure, incomplete — and a portfolio of mutually reinforcing arguments is more robust than one strong line that may not survive scrutiny.
  • Not a stage of wording or arrangement. Invention is marked off from style (elocutio) and arrangement (dispositio): it concerns which arguments the case affords, not how they are ordered or phrased. Clarity

Naming invention makes legible that discovering what could be said is a distinct phase, prior to and separable from choosing how to say it. Without the canon, argument-finding dissolves into the undifferentiated act of "writing" or "preparing," and the rhetor who has hit on a plausible line slides straight into arranging and wording it. By marking invention off from arrangement, style, memory, and delivery, the canon isolates a stage with its own task and its own standard, and lets a practitioner ask a question the fused activity hides: not "is my argument well put?" but "have I yet found which arguments this case affords?" The order is the point — premature commitment to the first defensible move risks bypassing stronger material and locking onto a position that later scrutiny undermines, so the canon's first demand is to canvass before selecting, treating the survey of available moves as work that must finish before the work of choosing begins.

The canon's sharpest contribution is to pry apart two things ordinary talk of "a good argument" runs together: the coverage of the argument space and the quality of any single argument within it. Facing a fresh case, a rhetor confronts an open-ended question with no natural floor or ceiling: what could be said here? The set of possible arguments for any dispute is effectively unbounded, the situation's particulars are inexhaustible, and "preparing" as an undifferentiated act gives no signal of when the search for material is adequate versus when a whole class of available move has been missed. Invention compresses that open search into a traversal of a small, fixed catalogue. Rather than confront the limitless particularity of cases, the rhetor confronts the topoi — definition, division, comparison, cause and consequence, testimony — and visits each in turn, asking at each whether it yields something defensible for this case. The sprawl of possible things-to-say collapses to a bounded enumeration of argument-types; the only thing that varies case to case is the material each topos surfaces, while the catalogue of places to look stays fixed. What the rhetor tracks is reduced to which topoi have been canvassed and which remain, and the adequacy of the inventional phase reads off that directly: complete when every applicable place has been visited, incomplete otherwise, with the unvisited topoi naming exactly where any remaining arguments must lie.

The decisive compression is that the canon converts an unmeasurable standard into a checkable one by separating coverage from quality. Without the catalogue, thoroughness of search is undefined — there is no denominator against which to ask whether material was missed, so a thin case and a fully-canvassed-but-genuinely-sparse case look identical, and a speech that rings shallow invites diffuse blame. The topoi supply the denominator: because they enumerate the types of move that exist, coverage becomes a quantity an analyst can audit, and a rhetor who has worked every applicable place has positive assurance of not having overlooked an entire class of argument — an assurance no unsystematized fluency can give. This is what makes the canon's signature diagnosis possible. Before deciding what story to tell, the rhetor canvasses the catalogue in turn. Definition: is the act "murder" at all, or does it meet the definition of lawful self-defense? Division: what are the separable issues — whether the accused struck the blow, whether he intended death, whether he was provoked? Comparison: how does this case stand against precedents where killings were excused? Cause and consequence: what led to the encounter, and what follows if the plea of self-defense is accepted or rejected? Testimony: which witnesses, character references, or laws bear on it? Only after every applicable place has been visited does the advocate turn to choosing which of the surfaced lines to build the defense around.

Applied / In Practice

Legal case preparation is the living descendant of this canon. Law students are drilled in "issue-spotting" and the IRAC framework (Issue, Rule, Application, Conclusion), which are lineal heirs of the inventional topoi: faced with a fact pattern, the lawyer systematically canvasses every claim, defense, and element that the facts might support before committing to a theory of the case. A litigator who seized on the first promising cause of action and drafted around it risks discovering, after filing, a stronger claim or an unanswered element that fuller canvassing would have caught. The discipline is explicitly coverage-first: the checklist of possible issues is the denominator against which the preparation is judged complete, and only once the space of available arguments has been surveyed does the advocate select the theory to advance at trial.

Structural Tensions

Diagnostic: Is coverage here being pursued as a route to the strongest available argument, or as a self-justifying checklist that certifies thoroughness while the case remains mediocre?

T2: Canvass-before-commit versus the stopping problem (thoroughness has a cost the canon underprices). Quarantining discovery from selection — keep canvassing even after a strong line appears — guards against premature commitment, the canon's signature discipline. But it inverts into an open-ended demand: within each topos the search for material is unbounded, exhaustive canvassing has real time-cost and diminishing returns, and "finish the survey before choosing" gives no principled floor for when the survey is enough. The fixed catalogue bounds the types to visit but not the depth of search at each, so a rhetor can over-invest in coverage past the point of value, or a deadline can force commitment mid-canvass with no rule for triaging which unvisited places matter most. Diagnostic: Does "complete coverage" here mean every argument the case affords was found, or only every argument-type the catalogue happens to enumerate — and what might lie outside the list?

T4: Upstream diagnosis versus mis-localization (blaming invention for a downstream fault).
