Default Enrollment with Notice¶
Procedure — instantiates Mandatory / Default Rule Design
Places eligible people on a beneficial path while giving timely, salient notice and a usable way to decline.
Some good outcomes are lost not to refusal but to inertia — the form never filled, the choice never faced. Default Enrollment with Notice captures those outcomes by setting the beneficial option as the starting position: eligible people are placed on the path automatically, then told clearly and in time that they have been, and given a genuine way out before anything irreversible attaches. Its defining move is that participation is the presumed state rather than the chosen one, but choice is preserved by making the enrollment visible and defeasible — the point is to flip who has to act, not to hide that a decision was made on someone's behalf. It is a coordination device for the ordinary case, not a mandate: the whole design stands or falls on whether the notice is understood and the exit is real.
Example¶
A university has long offered a subsidized student health plan, but every year hundreds of students who qualify for it — disproportionately first-generation and international students unfamiliar with the enrollment portal — simply never sign up, and discover the gap only when a medical bill arrives. The registrar switches to Default Enrollment with Notice. At registration, every eligible student is placed on the plan. Before the first premium is charged, each receives a plain-language notice — not buried in a terms page — stating that they are enrolled, what it costs, what it covers, and exactly how to decline or switch, in a single step through the same portal they already use. Students with their own coverage waive out in a few minutes; the students who used to fall through the gap are now protected by default. The administration also checks who opts out and how easily: if waiving turns out to be far harder for students using screen readers or non-English interfaces, that is a defect in the enrollment design, not a revealed preference against coverage.
How it works¶
- Confirm eligibility, then enroll. Place the eligible person on the beneficial path as the starting state, before any action is required of them.
- Notify before consequences attach. Salient, plain-language notice reaches the person while the choice is still costless — before the deduction, the charge, or the lock-in.
- State the terms and the rationale. What the default is, what it costs and covers, and why it was chosen — so the person can evaluate it rather than merely receive it.
- Provide a same-channel decline. Exit is available through the channel they already use, in about the effort of staying, so inaction and action are not asymmetrically punished.
- Map who benefits and who bears the attention cost. Check that the "beneficial" default actually fits the enrolled population and does not quietly disadvantage anyone whom it assumes wrongly.
Tuning parameters¶
- Notice lead time — how far ahead of the first consequence the notice lands. More lead time protects real choice; too much and the notice is forgotten by the time it matters.
- Notice salience — a standalone, plain notice versus a clause inside boilerplate. High salience preserves consent but competes for limited attention; over-salient nagging erodes the inertia the default relies on.
- Enrollment breadth — everyone eligible, or only those with a strong fit. Broad enrollment captures more of the missed benefit but sweeps in people the default suits poorly.
- Reversibility window — how long, and how cleanly, a person can undo enrollment after consequences begin. Longer windows lower the stakes of a missed notice.
- Fit auditing — how hard you look for sub-groups the default misserves. More auditing catches default discrimination but adds monitoring cost.
When it helps, and when it misleads¶
Its strength is that it delivers a widely-beneficial outcome to exactly the people who would otherwise miss it through no real preference, while leaving preference-holders free — the well-documented power of a good default paired with honest disclosure.[n1] It is the right tool when participation helps most people, choice remains legitimate, and the only thing standing between people and the benefit is the friction of enrolling.
Its failure mode is the concealed mandate: enrollment without meaningful notice or a usable exit is not a default at all, only a mandate that avoids saying so. A classic misuse is timing the notice after the money moves, or making the decline path a phone tree while enrollment took one click — the low opt-out rate is then evidence of friction, not of preference. The guarding discipline is to treat the notice-and-exit as the load-bearing part: if you cannot show that people understood they were enrolled and could leave about as easily as they stayed, you have built a mandate wearing a default's clothes, and should either fix the exit or justify the mandate openly.
