Before anyone drafts a single clause, someone has to decide how much force the rule should carry — advisory, opt-in, default, targeted mandate, universal mandate, or physical constraint. The Mandatory / Default Decision Matrix makes that choice explicit instead of letting it hide inside drafting habits. It lays the candidate rule forms down one axis and the deciding conditions — harm severity, externality, rights at stake, reversibility, information quality, heterogeneity, enforcement capacity — across the other, then reasons through the cells to select the least forceful form that still reliably controls the harm. Its defining move is that the unit of decision is the degree of force itself, chosen up front and on the record; it does not draft the resulting rule, run the exit, or grant exceptions. It exists to stop the two reflexes the archetype warns against — mandating every good thing and optionalizing every preference — by forcing the force level to be argued rather than assumed.

Example

A mid-sized city is deciding how to handle helmet use on its new shared e-scooter fleet. The debate has already collapsed into "require helmets" versus "let riders choose," and the transportation office pulls it back to a matrix. Down one side: advisory signage, an opt-in helmet-rental add-on, a default-provided helmet the rider can skip, a targeted mandate for night riders, and a universal helmet mandate. Across the top, the deciding conditions. They work the cells. Severity and reversibility: head injuries are serious and hard to reverse — pushes toward force. Externality: the risk falls mostly on the rider, not third parties — pulls back from a universal mandate. Enforcement capacity: the city cannot actually verify helmet use on thousands of dockless trips without absurd cost — a universal mandate would be unenforceable theater. Heterogeneity and information: short daytime trips differ sharply from late-night ones. The matrix does not spit out an answer; it makes the reasoning legible, and the office lands on a default-provided helmet plus a targeted night-riding rule, recording why universal compulsion failed the enforcement test and why pure advice failed the severity test — a record a later council can revisit if the crash data shifts.

How it works

  • List the full force spectrum. Advisory through universal mandate through architectural constraint — including forms the sponsor did not propose, so the choice is real.
  • Fix the deciding conditions. Score each form against severity, externality, reversibility, rights, information quality, heterogeneity, and — decisively — whether compliance can actually be verified.
  • Name the protected interest and the authority. Anchor the whole comparison to a stated interest and a real mandate to regulate it, so force is not chosen for a purpose or over a population the decider cannot legitimately reach.
  • Select the least-forceful adequate form and record the dissent. Pick the lowest rung that reliably controls the harm; write down why the stronger and weaker forms were rejected, and preserve disagreement rather than laundering it.

Tuning parameters

  • Condition weighting — how much each column counts. Heavier weight on externality favors mandates; heavier weight on heterogeneity favors defaults and tiers. The weights encode a policy stance and should be visible.
  • Form granularity — how many rungs on the spectrum. Finer spectra find better-fitting force levels but slow the decision.
  • Evidence threshold — how much proof a condition score needs before it moves the choice. A high bar resists guesswork; too high stalls on unavailable data.
  • Enforcement realism — how skeptically verifiability is scored. Honest scoring kills unenforceable mandates early; optimistic scoring produces rules no one can apply fairly.
  • Rights-override switch — whether a rights limit can veto a form outright regardless of its score, so the numbers cannot overrule a hard constraint.

When it helps, and when it misleads

Its strength is that it converts a slogan fight into a structured comparison, exposing that force is a variable to be fitted to the risk — a graduated ladder of responses rather than a binary, in the spirit of responsive regulation's enforcement pyramid.[1] It is most valuable exactly when stakeholders disagree about whether a norm should bind or merely guide.

Its failure mode is the decorative matrix: scores and thresholds that were reverse-engineered to justify a form already chosen, so the grid launders a predetermined mandate (or a predetermined laissez-faire) behind a veneer of analysis. A classic misuse is letting a tidy aggregate number quietly override a rights-based limit or paper over weak evidence. The guarding discipline is to fix the condition weights and the evidence each score rests on before comparing forms, and to keep rights limits as vetoes rather than as one more weighted column — so the matrix tests a decision instead of dressing one up.
