Reviews proposed weights for legitimacy, impact, and acceptability.
Once weights have been proposed, someone with standing must decide whether they may be used. Stakeholder Weight Review Panel is the accountable body that sits in judgment: it takes an already-proposed weight set and rules on whether it is legitimate, whose interests it serves and harms, and whether any weight illegitimately trades away a protected minimum. Its defining idea is that it is a gate, not a generator — its output is approval, conditional approval, or rejection, backed by the authority of the people affected or their representatives. It does not craft the weights or argue them into existence; it examines what was handed up, checks it against a legitimacy standard and against non-negotiable floors, and decides whether it passes. The panel is where a weighting rule earns — or is denied — the right to govern real decisions.
Example¶
A regional organ-allocation committee is handed a proposed reweighting of its transplant-priority score, which combines medical urgency, expected benefit, waiting time, and geographic proximity. The proposal, from the analytics group, would raise the weight on expected benefit to lift total life-years. The Stakeholder Weight Review Panel — clinicians, an ethicist, and patient representatives — convenes not to redo the math but to judge it. They ask who wins and loses: the change systematically deprioritizes older and sicker candidates. They test it against a legitimacy standard requiring that priority rules be defensible to those they disadvantage. Crucially, they check it against a protected threshold the system holds sacred — that no candidate above a defined urgency level may be deprioritized on efficiency grounds — and find the proposal quietly breaches it, letting the benefit weight compensate around a floor meant to be non-negotiable. The panel rejects the proposal on that ground and returns it with the floor reaffirmed. The weights were technically coherent; they were not legitimate.
How it works¶
- Review, don't author. The panel starts from a concrete proposed weight set and evaluates it; it does not run the elicitation itself.
- Judge by representation. Its membership deliberately includes affected interests, so the acceptability test is grounded in who bears the consequences, not just who is technically expert.
- Test against an explicit legitimacy standard. The panel applies stated criteria — transparency, representativeness, appealability, equity — rather than reacting case by case.
- Guard the floors. A distinct step checks whether any weight lets an ordinary objective compensate around a protected minimum, catching the silent conversion of a hard constraint into a tradeable preference.
Tuning parameters¶
- Composition — how broadly affected interests are represented versus expert-heavy. Broader panels strengthen legitimacy but slow decisions and can deadlock.
- Authority — advisory, veto, or binding approval. Real authority makes review consequential but concentrates institutional risk; advisory panels are easy to ignore.
- Legitimacy criteria strictness — how demanding the acceptability bar is. Strict criteria protect the disadvantaged but reject more proposals and can ossify.
- Protected-floor list — which minima are declared non-negotiable and off-limits to weighting. A longer list is safer but reduces optimization room.
- Appeal pathway — whether rejected or aggrieved parties can escalate. Appeals add legitimacy and delay in equal measure.
When it helps, and when it misleads¶
Its strength is conferred legitimacy: a weighting rule that has survived scrutiny by the people it affects, and that provably respects its protected floors, can withstand challenge in a way an analyst's spreadsheet never can. The panel is also the natural place to catch the most dangerous failure — a hard constraint being silently reweighted into a mere preference.
Its failure mode is performative review: a rubber-stamp panel that meets, nods, and approves whatever it is handed, lending false legitimacy precisely because it looks like oversight. The classic misuse is stacking the panel with insiders so the "stakeholder" review has no adversarial teeth. The guarding discipline is real procedural justice[n1] — genuine representation of dissenting interests, a documented basis for each decision, and a live appeal path — so that approval means something was actually at risk of rejection.
