Capacity Reservation Rule¶
Procedure — instantiates Displacement-Aware Capacity Admission
A rule that reserves part of the shared substrate for incumbent, public-good, safety, ecological, or vulnerable uses.
Some incumbent uses are too important, too diffuse, or too easily bullied to survive an open competition for the substrate — so you fence them off before anyone competes. Capacity Reservation Rule is the standing, ex-ante procedure that carves out a portion of shared capacity and declares it off-limits to entrants: a protected floor for safety, ecological, public-good, or vulnerable uses, and a corresponding admission rule that says a newcomer may only draw on what remains outside the reserve. Its defining move is prevention by construction: the protected function is never at risk because the entrant is never allowed to reach it in the first place. It sets aside space and gates admission at the front door; it makes no attempt to watch what happens after a newcomer is admitted, because if the rule works there is nothing to catch.
Example¶
A river popular for both commercial rafting and traditional subsistence fishing runs through a stretch managed by a permit system. Outfitters want more launch slots; each new commercial trip is measurable revenue, while the subsistence fishers' use is seasonal, informal, and easy to overlook. Rather than let commercial demand bid the fishers off the water, the managing authority writes a Capacity Reservation Rule. It fixes a protected floor: a defined block of morning launch windows and a stretch of riverbank access are reserved for subsistence and ceremonial use, permanently, regardless of commercial demand.[n1] The admission rule follows directly — new commercial permits are issued only against the discretionary launch slots that remain after the reserve is booked, and an application that would encroach on the reserved windows is simply ineligible, not weighed.
An outfitter applies for twelve new dawn trips. The rule doesn't convene a debate about whether rafting is more valuable than fishing; the dawn windows are inside the reserve, so those twelve are declined at the front door and the outfitter is pointed at the midday slack instead. The subsistence use never has to defend itself, because it was never on the auction block. The reservation did its work before any displacement could begin.
How it works¶
The rule's distinguishing logic is that the floor exists and binds before any entrant is evaluated:
- Set the reserved floor. Convert the protected functions flagged in the register into a concrete reserved quantity — specific slots, acre-feet, GPUs, shelf-facings — booked off the top.
- Define eligibility, not preference. Write the admission rule so entrants may claim only discretionary capacity outside the reserve; an encroaching request is ineligible, not merely disfavored, removing the need to litigate its merits case by case.
- Make the reserve durable. Fix the floor by policy so it does not erode under repeated high-value demand — the whole point is that it holds precisely when pressure is greatest.
- Route excess demand to slack. Direct entrants toward the discretionary tranche, so the rule channels growth rather than merely blocking it.
Tuning parameters¶
- Reserve size — how much capacity is fenced off. A generous reserve robustly protects vulnerable uses but forecloses growth even when slack was real; a thin one admits more but leaves the floor exposed.
- Rigidity — hard set-aside versus a reserve that can be released under defined conditions. Hard reserves are predictable and hard to erode; flexible ones adapt but invite pressure to "just release a little."
- Eligibility bright-line — how sharply the in-reserve / out-of-reserve boundary is drawn. A crisp line is cheap to administer and hard to game; a fuzzy one allows nuance but reopens case-by-case fights.
- Protected-class scope — which uses qualify for the floor. Broad scope protects more but shrinks discretionary space; narrow scope frees capacity but risks leaving a vulnerable use unlisted.
When it helps, and when it misleads¶
Its strength is that it protects exactly the uses the archetype warns are most easily sacrificed — the diffuse, informal, ecological, or low-status ones — without requiring them to win a fight they are structurally positioned to lose. Because it acts at the front door, it prevents displacement rather than remediating it, which is cheaper and surer than any after-the-fact correction.
Its failure mode is a reserve set by yesterday's understanding that quietly becomes wrong. A floor fixed too high sterilizes capacity that could have served real needs; one fixed too low provides false comfort while the protected use degrades within its own supposedly safe allotment. Reservations are also politically sticky — easy to erode slot by slot under sustained high-value demand, and hard to enlarge once entrants have organized around the discretionary space. The guarding discipline is to size the reserve from the register's dependency data, revisit it on a schedule, and defend the bright line against "just this once" exceptions. Note the boundary with its twin: this rule prevents displacement by fencing capacity off before admission and never watches the aftermath; the Moratorium and Reversal Gate does the opposite, letting admission proceed and stopping or unwinding it only after monitoring shows a breach.
How it implements the components¶
The rule is a front-door reservation procedure filling two decision components:
protected_function_floor— fixes the reserved quantity for protected functions as a durable, binding set-aside, not just a stated number.admission_or_expansion_rule— encodes the eligibility test that entrants may claim only discretionary capacity outside the reserve, declining encroaching requests by construction.
It does not fire the reversal_or_moratorium_trigger or keep a displacement_accountability_record — those belong to its twin, Moratorium and Reversal Gate, which acts after admission; this rule acts before it. It does not run the phase_in_monitoring_loop — that is Phased Admission Trial — nor build the mitigation_relocation_or_offset_path, which is Offset or Relocation Plan.
