Emergency Temporary Threshold¶
Exception protocol — instantiates Satisficing Threshold Design
Authorizes a relaxed, time-limited good-enough bar under verified urgency, with nonwaivable floors intact, an automatic expiry, and a standing fallback, so ordinary standards return by the clock rather than by convenience.
An Emergency Temporary Threshold is a bounded, expiring exception to the ordinary sufficiency bar, granted by a named authority when delay would cause immediate material harm. Its defining move is that the relaxation is time-limited by construction: it carries an expiry date, an intensified-monitoring requirement, and a pre-armed fallback, so the ordinary threshold returns automatically when the clock runs out rather than whenever someone gets around to it. It is not a lower standard — it is a documented deviation with a sunset attached. Crucially, it relaxes only the compensable, tradeable dimensions; the nonwaivable floors stay in force, which is what keeps an emergency from becoming a blanket permission to accept anything.
Example¶
A river breaches its levee overnight and a city's emergency operations center must open a mass-care shelter by dawn — the ordinary facility-procurement process takes three weeks, which the situation does not have. The incident commander invokes an emergency temporary threshold: any building with working power, sanitation, and a fire-safe egress path (the nonwaivable floors, which do not relax) may be used, even if it fails the ordinary standards for parking, ADA circulation, and lease terms. The authorization is signed, scoped to this incident, and stamped to expire in seventy-two hours. A shuttered school gym is opened under the temporary bar, with a caseworker assigned to log every deviation and a backup site held in reserve. When the seventy-two hours lapse, the exception does not renew on its own: either the ordinary criteria are met, a fresh authorization is signed with new evidence, or occupants transfer to the fallback. The emergency bought speed without quietly rewriting what "acceptable shelter" means.
How it works¶
- Verify the urgency independently. The trigger is a documented, checkable emergency — not merely asserted time pressure — and a named authority signs the deviation.
- Relax only the compensable bar; hold the floors. Tradeable thresholds may drop; safety, legality, rights, and feasibility floors remain conjunctive and non-negotiable.
- Attach a hard expiry and a fallback. The exception is scoped to the incident, dated to sunset, and paired with a monitored fallback option that can take over on lapse.
- Log deviations and hand off with the safeguards attached. The temporary choice is transferred to an accountable owner together with its expiry, monitoring plan, and remedy path, so no one inherits the shortcut without inheriting its guardrails.
Tuning parameters¶
- Expiry horizon — how long the temporary bar lasts before automatic reversion. Longer horizons reduce re-authorization churn but risk the exception hardening into the norm.
- Renewal evidence bar — what a second authorization must show. Requiring fresh evidence for renewal (never automatic) is the main guard against an emergency ratchet.
- Floor set held fixed — which conditions stay nonwaivable under urgency. Widening this protects against harm but narrows how much speed the exception can actually buy.
- Fallback readiness — how fully the reserve option is stood up. A warm fallback makes lapse safe; a merely notional one turns expiry into a cliff.
When it helps, and when it misleads¶
Its strength is proportionate speed: it lets a decision close in hours when the ordinary process would take weeks, without pretending the shortcut is the standard and without touching the floors that protect people. The honest failure mode is the emergency ratchet — a temporary bar that is renewed, and renewed, until the exception is the de facto rule and the ordinary standard is forgotten; this is a form of the normalization of deviance, where a once-flagged shortcut quietly becomes routine.[n1] The classic misuse is manufactured urgency: inventing or inflating time pressure so a favored option can skip comparison and review. The guarding discipline is a real expiry with no automatic renewal, independent verification of the urgency, and a retrospective review after the fact — the same logic as a legislative sunset provision, which forces a rule to justify itself again or lapse.
