Negotiation Derailment Repair Protocol¶
Facilitation protocol — instantiates Divergence Detection and Correction
Detects when a negotiation is hardening positions instead of converging, and applies structured repair moves — reframe, separate issues, caucus, escalate — without coercing false agreement.
A negotiation is supposed to move parties toward an agreement, but it can just as easily move them apart — positions harden, trust erodes, the same argument loops. Negotiation Derailment Repair Protocol is the facilitator's toolkit for that reversal: it reads why the talks are diverging, then reaches for the repair move that matches the cause. Its defining constraint separates it from every mechanical corrector in this family — the goal is genuine convergence, not the appearance of it, so the protocol must never coerce a false agreement to make the divergence signal go quiet. Its correction menu is social and diagnostic: reframe the problem, separate entangled issues, call a caucus, bring in evidence, or escalate to a mediator or higher authority. And it carries an honest abort: a point at which the right move is to suspend or end the talks, preserving legitimate disagreement, rather than force a settlement no one will honor.
Example¶
Two departments are negotiating how to split a shared engineering budget, and by the third session it is going backwards. Each side now argues a bigger number than it opened with, cites the other's "bad faith," and re-litigates points that seemed settled. The facilitator runs the diagnosis frame: is this an incentive conflict (each rewarded only for its own headcount), a single entangled issue (budget fused to an unspoken fight about org status), or distrust from a prior broken promise? The read is entanglement plus distrust. The matched corrections follow in order: first separate the issues — split "this year's dollars" from "who owns the platform," which turns out to be the real dispute; then a short caucus with each side alone to surface what they actually need; then a reframe from "divide a fixed pot" to "fund the two projects that unblock both teams." Positions begin to move. Had the reframe failed, the protocol's abort condition was explicit and pre-agreed: escalate the platform-ownership question to the shared VP rather than pressure either lead into conceding it in the room. What the protocol prevented was the classic bad outcome — a signed compromise that collapses in a month because it was extracted, not agreed.
How it works¶
- Detect the reversal, not just the disagreement. The trigger is movement away from agreement — hardening, re-litigation, rising personal attribution — distinct from healthy, substantive disagreement.
- Diagnose the cause. Route through a frame: incentive conflict, issue entanglement, distrust, information asymmetry, or a party negotiating against a strong walk-away alternative. The cause selects the repair.
- Apply the matched move. Separate issues, reframe the problem, caucus privately, introduce shared evidence, or bring in a neutral — the least coercive move that addresses the diagnosed cause.
- Escalate or abort honestly. If repair fails, route the unresolved issue to a mediator or higher authority, or suspend the talks — never manufacture consent to silence the derailment.
Tuning parameters¶
- Detection sensitivity — how quickly a rough patch is read as derailment. Sensitive facilitation intervenes early but can smother productive friction; insensitive lets hostility calcify.
- Intervention depth — a light reframe vs. a full agenda reset and caucus. Deeper moves reset a badly derailed talk but cost momentum and can feel heavy-handed.
- Directiveness — how strongly the facilitator steers versus letting parties find their own way. High directiveness resolves faster but risks a facilitator-imposed deal.
- Abort threshold — how much failed repair precedes suspending or escalating. A low threshold protects people from coercive marathons; a high one keeps trying when a deal is still reachable.
- Dissent tolerance — how much residual disagreement is accepted as a legitimate outcome rather than a failure to be corrected.
When it helps, and when it misleads¶
Its strength is catching a talk that is degrading — not merely hard — and repairing the process before positions calcify into an impasse, while protecting the thing mechanical correctors ignore: a party's legitimate right to disagree and to walk to its BATNA.[n1] Diagnosing cause before acting keeps the facilitator from applying a caucus to what is really an incentive problem.
Its failure mode is the dark side of "correction" in a social system: suppressed dissent. A protocol tuned to make the divergence signal disappear can slide into pressure to conform — declaring consensus, isolating the holdout, reframing until objection sounds like obstruction — producing a false agreement that hides unresolved conflict rather than resolving it. The classic misuse is treating any dissent as derailment to be corrected. The guarding discipline is the built-in abort and a floor of dissent tolerance: some divergence is a signal that the deal is wrong, and the honest response is to escalate or stop, not to engineer agreement.

It deliberately does not implement noise_filter or monitoring_cadence — it has no automated sampling loop; continuous smoothed monitoring is Model Training Divergence Monitor's. Nor does it implement rollback_point; reverting to a last-good configuration is Process Control Alarm and Tuning's move.

The abort condition here is unusual among divergence mechanisms: aborting can be the correct convergence outcome, because a negotiation that reveals genuinely incompatible interests should surface that fact rather than paper over it.
